FEDERAL COURT OF APPEALS UPHOLDS LARGEST CLASS CERTIFICATION IN HISTORY IN WAL-MART GENDER DISCRIMINATION CASE

Today the Ninth Circuit Court of Appeals upheld the decision to certify a class of all women employed at Wal-Mart's U.S. facilities at any time since December 26, 1998. The case claims that Wal-Mart discriminates against women in pay and promotions. Information about the case and the court's decision is at www.walmartclass.com.

The Ninth Circuit described the case as "the largest certified class in history." In upholding San Francisco District Court Judge Martin Jenkin's decision, the Ninth Circuit found that plaintiffs' "present significant proof of a corporate policy of discrimination and support Plaintiffs' contention that female employees nationwide were subjected to a common pattern and practice of discrimination."
